1. Application
1.1. These terms supplement the Public Offer and the User Agreement in respect of Lynx Voice. "Lynx Voice" means voice assistants and software speech functions (conducting voice dialogs, recognising speech and converting it into text, converting text to speech, recording and analysing dialogs). Access is provided only to the features specified in the Order.
1.2. The Order determines the features, the methods of connecting voice assistants, the price, the usage units, the limits and the connection responsibilities. These terms take precedence on matters of Lynx Voice in accordance with the order of precedence established by the User Agreement (section "Conclusion of the contract"). The general rules on acceptance, payment and refunds continue to apply.
1.3. Voice assistants in the browser and on the Client's website are available to Clients with an approved Team Account. Voice assistants are connected to the Client's own PBX and communication channels only under Enterprise terms.
2. Connection, communications and payment
2.1. The Provider provides software functions for speech recognition and speech synthesis and for conducting voice dialogs. The Provider is not a telecommunications operator or provider, does not provide communication services, does not allocate, sell or resell subscriber numbers, communication channels or carriage of traffic, and does not provide access to telecommunications networks. An Order does not and cannot include such numbers, channels, traffic or communication services. The Client obtains and uses its own PBX and communication channels under its own contracts with a communications operator, pays for them at its own expense and itself complies with the requirements that apply to a subscriber and user of communication services, including requirements on the use of numbers and on sending advertising.
2.2. A Client that has connected its own PBX and communication channels ensures their protection against unauthorised use, including by restricting, by arrangement with its communications operator, the destinations and volume of outgoing connections and by protecting credentials and network settings, and informs the Provider without delay of any signs of such use. Fees payable to the communications operator, including for traffic generated as a result of unauthorised use of the Client's equipment or credentials, are paid by the Client; the Provider does not reimburse them unless such use was caused by the Provider's breach of its security obligations.
2.3. Before a paid launch, the method of measuring the duration of a voice dialog, rounding, the treatment of waiting time, interrupted connections, unanswered attempts, retries and errors, the rate and the budget are stated. Fees payable to the communications operator are not included in the Order price. Billing errors are corrected under the Public Offer. Individual availability levels agreed in Enterprise terms do not extend to the Client's own PBX and communication channels, the networks of communications operators or the internet.
3. Voice rights and processing of recordings
3.1. The Service does not create voice copies, that is, models that reproduce the voice of a particular person, and does not accept voice samples for that purpose. Text is converted to speech only with the standard voices of the Service.
3.1.1. The standard voices of the Service are provided for converting text to speech within the features of the Service. The Client must not create a voice copy from audio voiced with a standard voice, must not reproduce a standard voice outside the Service and must not claim that a standard voice belongs to a particular real person.
3.1.2. Using a voice for deception, impersonation or circumventing voice-based identity verification is prohibited.
3.1.3. The Client keeps evidence of notices given to Interlocutors and of consents obtained, including consents to recording and advertising, for the entire period of use of the recording or communication and for at least three years after that period ends, unless a longer period is established by law, and provides them to the Provider upon a reasoned request within five working days of the request, unless the request specifies a longer period.
3.2. The Client ensures that Interlocutors are notified and that consents are obtained in accordance with the User Agreement (section "Use of artificial intelligence"), and ensures the opportunity to refuse provided for by law. If the Service contains notification tools, the Client checks their wording and that they are enabled before launch; the availability of such tools does not transfer the Client's obligations to the Provider.
3.3. Recording and storage are enabled in the selected mode. Recordings are stored in the Republic of Uzbekistan. Retention periods for audio recordings and transcripts, access to them, their destruction and computing operations outside the Republic of Uzbekistan are governed by the Privacy Policy and the applicable Data Processing Agreement. Mandatory retention is determined by law.
3.4. The Client's rights to the original recordings and to lawfully generated audio are preserved. Granting access to Lynx Voice features does not transfer the source code, the model parameters or rights to the Provider's software technology. This provision does not give the Provider the right to use a voice beyond the permitted purposes and does not restrict the mandatory destruction of personal data.
3.5. The Provider does not process biometric personal data: voice characteristics are not extracted from recordings or stored, and voice is not used to establish a person's identity.
4. Use of the voice assistant
4.1. Before launch, the Client checks the scenario, notices, pronunciation, information, translations, available actions and the handover of an enquiry to a human. An outbound voice dialog is permitted only with a lawful recipient, under a permitted scenario and within the set budget; an outbound dialog of an advertising nature is permitted subject to compliance with the Acceptable Use Policy (section "Communications and integrations"). An Interlocutor's words or recognised text do not by themselves confirm the Interlocutor's identity, authority or consent to a transaction or payment; the Client ensures the verification required by law and by the nature of the operation. Significant decisions and actions are subject to the rules of the User Agreement on authority and human oversight.
4.2. Lynx Voice must not be used as an emergency service or as the only means of obtaining help where life is at risk. The Client must not present the assistant as a means of contacting emergency services. If an enquiry may concern a threat to life, health or safety, the scenario provides for informing the Interlocutor that they need to contact emergency services themselves. Round-the-clock automation depends on the availability of systems and the network; individual guarantees may be established only by Enterprise terms. Where there are reasonable indications of infringement of voice rights, where the necessary confirmations are not provided within the set period, or in the event of a security threat or a requirement of law, the Provider may restrict the affected feature in the manner established by the User Agreement (section "Breaches, suspension and termination").
4.3. A text transcript of a voice dialog or of a conversation recording, quality assessments, information on an Interlocutor's interest and other analytical results are generated automatically and may contain errors, omissions or misinterpretations. Before using such results for significant actions, the Client checks them against the original recording and other available information. Decisions that have legal significance and affect the rights and freedoms of a person must not be based solely on conclusions of artificial intelligence. The User Agreement (section "Use of artificial intelligence") applies to quality assessments and other Automated Assessments.
4.4. The Client ensures that in an outbound voice dialog the assistant, at the beginning of the conversation, names the Client on whose behalf the dialog is conducted and the purpose of the contact, and states that the Interlocutor is speaking with a software assistant. The Client configures the scenario so that an Interlocutor's request not to be contacted again is recognised and recorded, and further outbound dialogs and messages to that Interlocutor under the relevant scenario stop. An outbound dialog of an advertising nature is permitted only with the Interlocutor's prior consent, evidence of which the Client keeps in accordance with clause 3.1.3.
