This Policy applies to all Users, all plans and Enterprise terms, and to all features of the Service, including text agents, Lynx Voice voice assistants and tools for creating materials, together with the User Agreement, the Public Offer in the case of paid access and the Lynx Voice Supplemental Terms when Lynx Voice is used. In this Policy, "User" means the Client and Client Users.

1. Lawfulness and rights

1.1. The User acts within the limits of its authority, applicable legislation and the rules of the platforms being connected, and complies with the requirements concerning personal data, advertising, intellectual property and the use of artificial intelligence. The User ensures that it has the necessary rights and grounds for uploading, processing and distributing materials and data of third parties.

1.2. Fraud, phishing, extortion, unlawful sale of goods and services, aiding a crime, fabrication of evidence and deception as to identity, authority or the origin of material are prohibited. Sexual exploitation of children, material depicting sexual violence, unlawful intimate material distributed without consent, credible threats, targeted harassment and disclosure of private data in order to cause harm are prohibited.

1.3. Infringement of copyright and related rights, of rights to one's image and voice, of trade marks or of trade secrets; uploading of unlawfully obtained databases and recordings; and imitation of the voice of a particular person and circumvention of voice-based identity verification by means of speech synthesis are prohibited.

1.4. The creation and distribution of material sexualising minors and the targeted collection of personal data of minors by means of agents without the consent of their legal representatives are prohibited. Scenarios aimed primarily at minors are permitted only where the consents and safeguards provided for by legislation are in place, and must not contain advertising of goods and services the advertising of which to minors is prohibited.

1.5. It is prohibited to use the Service to impersonate a state body, a bank, a payment organisation, a communications operator or any other organisation on whose behalf the User is not entitled to act, or to obtain from an Interlocutor passwords, confirmation codes, payment card details or other information that makes it possible to dispose of the Interlocutor's funds or accounts.

1.6. In requests to create music and songs, it is prohibited to specify the names of performers and authors or the titles of works, or to use recognisable fragments of other persons' texts, if the purpose of the request is to obtain an Output that reproduces a protected work or creates a false impression of a performer's participation.

2. Communications and integrations

2.1. Spam, unlawful advertising voice dialogs and mailings, collection of contacts for prohibited messages, circumvention of blocks and limits, sender spoofing and concealment of mandatory information about advertising or automation are prohibited. The presence of a contact in a customer database does not in itself confirm consent to advertising. Advertising requirements are set out in clause 2.3.

2.2. It is prohibited to connect other persons' accounts, phone numbers, access keys and channels without authority, or to use permissions granted for an Integration outside the agreed purpose. The User complies with the additional requirements of the connected platform.

2.3. When sending advertising by means of the Service, including through agents, mailings, outbound voice dialogs and follow-up scenarios, the User is the advertiser and the distributor of the advertising. The User determines the content, recipients, timing and method of distribution of the advertising and ensures compliance with the requirements of advertising legislation, including by:

(a) obtaining the prior consent of the recipient where it is required by legislation or by the rules of the channel, and retaining evidence of the consent for as long as the consent remains valid and for at least three years after advertising messages to that recipient have ceased;

(b) in a voice dialog, before communicating advertising information, informing the Interlocutor that the information is advertising, whether it is provided free of charge or for a fee and at what cost, and of the age and other restrictions established in respect of the advertised product;

(c) distributing advertising in the state language; translation into other languages is permitted provided that it does not distort the meaning of the advertising;

(d) stating prices in the national currency;

(e) complying with the restrictions on advertising addressed to minors and the restrictions on advertising of particular goods and services;

(f) ceasing advertising messages to a recipient who has opted out of them no later than the next working day after receipt of the opt-out, and providing an accessible means of opting out.

The Provider supplies software tools, does not determine the content, recipients, timing or method of distribution of advertising and does not assume the obligations of an advertiser or distributor. Upon a request from a recipient or a competent authority, the Provider may suspend the affected mailing or scenario until the User provides evidence of consent; the User provides such evidence within five working days from the date of the request.

2.4. It is prohibited to use an assistant to collect debts by means of threats, by misleading persons as to the consequences of non-payment, by contacting persons who are not debtors, or at times or by methods other than those permitted by legislation.

2.5. Election campaigning by means of the Service and the creation of messages and voice materials on behalf of candidates, political parties, state bodies and their officials are permitted only under Enterprise terms.

3. Artificial intelligence and automation

3.1. It is prohibited to use generated material to falsify evidence of an event or of a person's participation. It is prohibited to present an assistant as a real authorised person for the purpose of deception. The origin of material is disclosed where this is required by law or by platform rules, or to prevent anyone from being materially misled.

3.2. The User sets limits on access, actions and budget, checks the assistant before launch, monitors its operation and provides for stopping it and handing the enquiry over to a human. These requirements also apply to scenarios launched on a schedule or by an event. Without the necessary authority, an assistant must not send messages, execute transactions, change data, make payments or create external obligations. Circumvention of mandatory confirmation and deliberate use of other persons' messages or files to change the permitted authority are prohibited.

3.3. When making decisions that have legal significance and affect the rights and freedoms of a person, it is prohibited to rely solely on the conclusions of artificial intelligence. Medical, legal and financial decisions require the professional assessment and human oversight provided for by law. Regulated and hazardous scenarios are permitted where the necessary permits, professional supervision and agreed safeguards are in place. Use of the Service to provide emergency assistance or to control hazardous facilities is not permitted under standard access. The possibility of establishing for such purposes a separate regime that complies with legislation is considered only when Enterprise terms are agreed, taking into account mandatory requirements and the actual capabilities of the Service.

3.4. It is prohibited to configure an agent so that it presents itself as a human or denies its automated nature when asked by an Interlocutor. The agent's messages and voice must not mislead the Interlocutor as to the person on whose behalf they are sent. The obligations to notify Interlocutors are set out in the User Agreement (section "Use of artificial intelligence").

3.5. Technical marks indicating the origin of an Output, if the Provider applies them, do not replace the User's obligation to disclose the origin of material. It is prohibited to remove, alter or conceal such marks in order to pass off generated material as a recording of a real person or event.

4. Security and data

4.1. Unauthorised access, malicious code, attacks, gaining access to the workspaces of other organisations, extraction of other persons' data and secrets, unlawful security testing and deliberate overloading are prohibited. It is prohibited to use the Service as a means of attack or of unlawful distribution of materials, including through a connected program or another agent. Circumvention of billing, limits and safeguards, re-creation of accounts in order to continue prohibited activity and abuse of free allowances are prohibited.

4.2. Data requiring special processing conditions is used only where there is a lawful ground and appropriate safeguards are in place. A User who has obtained access to the data of another user of the Service immediately ceases such access and notifies the Provider; distribution of such data is prohibited.

5. Meta Channels

5.1. This section applies to the use of Meta Channels in addition to sections 1-4 of this Policy and to Meta's terms. Where the rules differ, the stricter rule applies.

5.2. Meta Channels are used only for communication between a Business Client and its customers and other persons in connection with its activities. Providing, through WhatsApp, access to artificial intelligence as the primary function of the channel is not permitted, including access to a general-purpose digital assistant that is not related to the User's goods, works and services.

5.3. On its own initiative, the User sends messages on WhatsApp only to persons who have provided the User with their phone number or username and have consented to receive messages from the User through WhatsApp. Contacting a person by voice through WhatsApp on the User's initiative requires separate consent. In Messenger and Instagram, messages are sent where there is consent that is sufficient under applicable legislation. The User keeps evidence of consent, provides a clear means of opting out of messages and complies without delay with any opt-out from messages or demand to stop them, received by any means.

5.4. After the expiry of the period during which Meta's rules allow free replies to the last message of an Interlocutor, the User sends only messages expressly permitted by Meta's rules for that situation: Meta-approved templates in WhatsApp, and permitted message tags and subscription-based advertising messages in Messenger and Instagram. Templates and tags are used only for their intended purpose. Advertising content is sent only in the formats designated by Meta for advertising. Follow-up scenarios and mailings are configured in compliance with these restrictions.

5.5. Where automated replies are used, the User provides the Interlocutor with a quick and clear way to contact an employee: handover of the dialog to an employee, a telephone number, email, a form on a website or another method permitted by Meta's rules. At the start of the dialog, after a significant break and when the dialog passes from an employee to an agent, the User informs the Interlocutor that the dialog is being conducted by a software assistant. When asked directly by the Interlocutor, the agent does not deny its automated nature.

5.6. Meta Channels must not be used:

(a) for goods, services and activities prohibited by Meta's rules, including weapons, alcohol, tobacco, medicines, medical devices and health products, real-money gambling, dating services, adult goods and services, multi-level marketing, payday loans, loans between individuals, debt collection, real, virtual and counterfeit currency, live animals and hazardous materials, except where expressly permitted by Meta;

(b) in the interests of political parties, politicians, candidates and election campaigns, or by law enforcement agencies, armed forces, or security and intelligence agencies;

(c) to request or transmit full payment card numbers, bank account numbers, identity document numbers and other identifiers that Meta's rules prohibit requesting, as well as health information, financial information, information about children and other categories of data in cases where Meta's terms prohibit their transfer to Meta;

(d) in Messenger and Instagram, for correspondence between medical organisations or healthcare professionals and patients and for obtaining or transmitting information about patients, and in WhatsApp, for remote medical consultations and the transmission of health information, where this is prohibited by law or by Meta's rules;

(e) to sell digital goods through Messenger and Instagram;

(f) to make decisions on the provision of housing, employment, insurance, education, credit or social benefits or on immigration status, for surveillance of persons, or for discrimination on grounds protected by law;

(g) to sell, license or buy Platform Data or otherwise transfer it to third parties, except for a transfer provided for in clause 5.8, or to use information about an Interlocutor received from Meta, other than the content of the correspondence, for purposes unrelated to communicating with that Interlocutor through the relevant channel;

(h) to forward information from a dialog with one Interlocutor to another Interlocutor;

(i) to impersonate another person or organisation.

5.7. The User maintains accurate information about itself and contact details for enquiries in its WhatsApp profile, on its Facebook Page and in its Instagram account, publishes its own privacy policy covering correspondence through Meta Channels, labels advertising messages and complies with the age and territorial restrictions established for its goods and services.

5.8. Platform Data is transferred from the Service to other systems through Integrations, export or event notifications on the User's instruction, only to the User's own systems or to persons processing the data on its instruction, within the limits permitted by Meta's terms. The User is responsible for the permissibility of such transfer.

5.9. Automated collection of data from Meta websites and applications outside the official application programming interfaces is prohibited, as is requesting from Interlocutors, employees or other persons log-in credentials for Meta accounts, including passwords.

5.10. In the event of a breach of this section, the User Agreement (section "Integrations, external channels and communications") and section 6 of this Policy apply.

6. Measures and complaints

6.1. The Provider may verify information about a breach, request the necessary evidence of rights, restrict the affected operations and suspend access in proportion to the breach and the risk. Where there are reasonable indications of an unlawful or dangerous scenario, an ongoing threat or a mandatory requirement of law, the relevant operations may be stopped immediately. Where permitted by law and where this does not hinder the prevention of harm, the User is informed of the ground, the means of remedy and the appeal procedure. Receipt of a complaint does not mean that a breach has been established. Only the information necessary for verification is requested. Providing knowingly false information, or failing to provide the necessary evidence of rights and authority within the period stated in the request, which is not less than five working days, may result in restriction of the affected access. Notice periods and the suspension procedure are determined by the User Agreement (section "Breaches, suspension and termination").

6.2. The Provider may preserve the necessary evidence of a breach to the extent permitted by law and for the period necessary for investigation, protection of rights or compliance with a mandatory requirement. Information is provided to competent authorities upon their mandatory lawful demands and to the extent provided for by law.

6.3. The User is liable for a breach of this Policy in accordance with the contract. Compensation by a Business Client for losses arising from third-party claims is made in the manner established by the User Agreement (section "Liability").

6.4. Complaints about breaches and about measures taken are sent to contact@lynx-ai.uz, stating the identifier of the item concerned, a description of the breach, the basis of the rights and contact details. A person who believes that their voice is being reproduced without permission includes the marker "Voice" in the complaint, together with details of the disputed material and a means of contacting that person. Pending completion of the review, the Provider may suspend the use of the disputed material. The Provider considers the evidence and corrects erroneous measures. Termination of access is carried out in the manner established by the User Agreement (section "Breaches, suspension and termination"), and settlements and refunds are made in the manner established by the Public Offer (section "Suspension, termination and refunds").

6.5. If infringements of the rights of third parties to materials, voice or image have been repeatedly confirmed in respect of an account, the Provider may unilaterally withdraw from the contract in the manner established by the User Agreement (section "Breaches, suspension and termination").

6.6. A new version of this Policy applies in the manner established by the User Agreement (section "Changes and notices"). Retention of a previous contractual version does not permit actions prohibited by current legislation and does not prevent protective measures provided for by law and by the accepted contract.
